General Terms and Conditions
1. Purpose
These General Terms and Conditions (GTC) govern the contractual relations between ATELIER FENICE PROJECT SÀRL, operating under the AGAMI brand, and its clients, for the provision of website creation services and digital solutions.
2. Services
ATELIER FENICE PROJECT SÀRL offers web design, development and maintenance services for the real estate sector, including: • One-page and multi-page website creation • Custom design and UX/UI • 3D integration and virtual tours • SEO optimization • Maintenance and technical support
3. Pricing and Payment
Prices are quoted in CHF excluding taxes. Payment is made according to the following schedule: • 70% upon signing the quote • 30% upon mockup delivery Any late payment will incur interest at the legal rate.
4. Delivery Times
Delivery times are provided for information purposes. ATELIER FENICE PROJECT SÀRL undertakes to meet the agreed deadlines as far as possible. No delay shall give rise to damages unless otherwise agreed.
5. Intellectual Property
Upon receipt of full payment, the client acquires usage rights for the delivered website. ATELIER FENICE PROJECT SÀRL retains intellectual property rights over creative elements, source codes and developed methodologies.
6. Termination
Either party may terminate the contract in the event of a serious breach by the other party, after formal notice has remained without effect for 15 days. In the event of termination by the client, sums already paid shall remain acquired by ATELIER FENICE PROJECT SÀRL.
7. Liability
The liability of ATELIER FENICE PROJECT SÀRL is limited to the amounts actually received under the contract in question. ATELIER FENICE PROJECT SÀRL shall not be held liable for indirect damages.
8. Applicable Law and Jurisdiction
These GTC are governed by Swiss law. Any dispute shall be subject to the exclusive jurisdiction of the courts of the canton of ATELIER FENICE PROJECT SÀRL's registered office.
